Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," or "Customer") and Endromeda ("Endromeda," "we," "our," or "us") governing your access to and use of the website at endromeda.xyz and all related products, services, and deliverables (collectively, the "Services").

By placing an order, clicking "Join Now," completing a purchase, or using any Endromeda product, you confirm that you:

• Are at least 18 years of age (or 16 in jurisdictions where that is the age of majority).
• Have read, understood, and agree to these Terms and our Privacy Policy.
• Have the legal authority to enter into this agreement.

Endromeda provides digital creator products and services, currently including:

• Brand DNA Kit ($99/mo) — a subscription product delivering brand positioning, content, offer, and email frameworks.
• Full Creator System ($497 one-time) — a comprehensive digital product bundle including templates, scripts, sequences, and strategy frameworks.
• Done-For-You Brand ($2,500+/project) — a bespoke managed service where our team builds custom brand assets and deploys systems on your behalf.

We reserve the right to modify, add, or discontinue any product or feature at any time with reasonable notice. Material changes to existing subscriptions will be communicated at least 14 days in advance.

Payment processing is handled by Stripe. By purchasing, you agree to Stripe's Terms of Service. We never store your card details.

Subscriptions (Brand DNA Kit): Your subscription will renew automatically each month on the date of your original purchase. You may cancel at any time before the next renewal date to avoid being charged. Cancellation is effective at the end of the current billing period — you retain access until that date.

One-time purchases (Full Creator System): Payment is charged in full at the time of purchase.

Project-based services (Done-For-You Brand): Payment terms are outlined in a separate project agreement. A deposit is required before work begins.

Taxes: Prices are listed exclusive of taxes where applicable. You are responsible for any applicable sales tax, VAT, or GST in your jurisdiction.

How to Submit a Refund Request

1. Email hello@endromeda.xyz with the subject line "Refund Request — [Your Order]".
2. Include: your full name, purchase email address, order reference or receipt number, and a brief description of your concern or reason for the request.
3. We will acknowledge your request within 1 business day and aim to resolve it within 5 business days.
4. Approved refunds are processed back to your original payment method via Stripe. Allow 5–10 business days for the funds to appear, depending on your bank or card issuer.

Eligibility Conditions

• The request must be submitted within the stated window from the date of purchase or delivery, whichever is later.
• You must have made a genuine attempt to use the delivered materials and clearly describe what did not meet your expectations.
• We reserve the right to offer a complimentary revision or additional support before issuing a refund, at our reasonable discretion.
• Refund requests submitted outside the guarantee window will not be eligible, regardless of reason.

Cancellations (Brand DNA Kit Subscription)

You may cancel your subscription at any time via the Stripe customer portal (link provided in your welcome email) or by emailing us. Cancellation is effective at the end of the current billing period. You will retain full access until that date. No partial-month refunds are issued for cancellations made after a billing cycle has started.

Chargeback Policy

If you initiate a chargeback or payment dispute with your bank or card issuer without first contacting us to attempt resolution, we consider this a material breach of these Terms. We reserve the right to:

• Immediately suspend access to all Endromeda products and services associated with your account.
• Dispute the chargeback and provide evidence of purchase and delivery to the payment processor.
• Recover any associated dispute fees from you if the chargeback is found to be unwarranted.

We strongly encourage you to contact us first — we will always work in good faith to resolve genuine concerns.

Digital products are delivered to the email address provided at purchase. It is your responsibility to provide a valid, accessible email address. We are not liable for non-delivery caused by an incorrect email address or a spam filter.

Delivery timelines:

• Brand DNA Kit — delivered within 24 hours of purchase.
• Full Creator System — delivered within 3–5 business days.
• Done-For-You Brand — full delivery and launch within 14 calendar days from project kick-off, subject to your timely provision of required inputs (brand assets, feedback, approvals).

Delays caused by your failure to provide required information or approvals do not constitute a failure on our part and will not entitle you to a refund.

What you own after purchase: Upon full payment, you receive a non-exclusive, non-transferable, personal licence to use the delivered materials for your own business. You may adapt, customise, and implement the frameworks for your own brand.

What you do not own:

• The underlying templates, methodologies, frameworks, and systems created by Endromeda remain our intellectual property.
• You may not resell, license, sub-license, white-label, or distribute Endromeda deliverables to third parties without our prior written consent.
• You may not claim the frameworks or systems as your own creation for commercial purposes.

Done-For-You Brand clients: Custom brand assets created specifically for your business (logo, custom copy, unique designs) are assigned to you upon final payment. We retain the right to showcase anonymised work in our portfolio unless you request otherwise in writing.

Website content: All text, graphics, logos, and other content on endromeda.xyz is owned by Endromeda and protected by copyright and intellectual property laws. You may not reproduce, republish, or distribute any website content without our written permission.

This Acceptable Use Policy governs how you may use Endromeda's website, app, products, AI-powered tools, and all related services. By using our services, you agree to comply with this policy. Capitalised terms have the meaning given in these Terms.

1. General Conduct

You agree to use Endromeda services only for lawful purposes and in a manner consistent with all applicable local, national, and international laws and regulations. You must not:

• Use the services for any illegal, fraudulent, deceptive, or abusive purpose.
• Impersonate any person, organisation, or entity, or misrepresent your identity or affiliation with any party.
• Harass, intimidate, defame, or threaten other users, our team members, or any third party.
• Engage in discriminatory conduct based on race, ethnicity, gender, religion, sexual orientation, disability, or other protected characteristics.

2. Platform Integrity

You must not take actions that compromise the security, integrity, or performance of our platform:

• Attempt to gain unauthorised access to any account, system, or network connected to Endromeda.
• Use automated bots, scrapers, spiders, or crawlers to extract data from our website or application without our prior written consent.
• Introduce malicious code, viruses, ransomware, or any software designed to disrupt, damage, or gain unauthorised access to our systems.
• Perform or facilitate denial-of-service (DoS or DDoS) attacks against our infrastructure.
• Attempt to bypass, circumvent, or reverse-engineer any security measure, authentication system, or access control.
• Share, transfer, or sell your account credentials to any other party.

3. Intellectual Property

• Do not copy, reproduce, redistribute, republish, resell, or create derivative works from Endromeda content, frameworks, templates, or deliverables for commercial purposes without our written consent.
• Do not claim ownership of, or sub-license, any proprietary Endromeda methodology, system, or creative asset.
• Do not infringe the intellectual property rights (copyright, trademark, patent, trade secret) of Endromeda or any third party while using our services.

4. AI Tools & Generated Content

Endromeda's app includes AI-powered features (including script generation, hook creation, content strategy tools, and MedaFlow). When using these features, you must not:

• Use AI-generated outputs to create misleading, deceptive, or fraudulent content intended to deceive consumers, platforms, or regulators.
• Use AI features to generate spam, unsolicited bulk messages, or content designed to manipulate platform algorithms in violation of those platforms' own terms of service.
• Attempt to generate content that is hateful, violent, sexually explicit involving minors, or otherwise harmful or illegal.
• Use our AI features to produce content that infringes third-party intellectual property or violates rights of publicity.
• Attempt to extract, reverse-engineer, or probe our AI system prompts, model configurations, or backend infrastructure.
• Use AI features to impersonate a real individual without their consent in a way that could cause harm or reputational damage.

AI-generated content is provided as a starting point. You are solely responsible for reviewing, editing, and ensuring the accuracy and appropriateness of any content you publish. See Section 9 (AI Disclaimer) for additional terms.

5. Content You Provide

For Done-For-You Brand clients and any service where you submit materials, data, or briefs to us, you represent that:

• You own or have the right to use all materials you provide to us.
• Your materials do not contain illegal content, defamatory statements, or content that infringes third-party rights.
• You will not submit content that misrepresents your business, product claims, or results in a manner that would expose Endromeda to legal liability.

6. Communication & Marketing Use

• Do not use email sequences, scripts, or content frameworks delivered by Endromeda to send spam, unsolicited bulk messages, or communications that violate the CAN-SPAM Act, CASL, GDPR, or other applicable anti-spam legislation.
• You are solely responsible for compliance with applicable marketing laws when deploying any content, email, or campaign strategy using our frameworks.

7. Enforcement

Violation of this Acceptable Use Policy may result in, at our sole discretion:

• Immediate suspension or permanent termination of your access to all Endromeda services, without refund.
• Removal of content or deliverables from our systems.
• Referral to appropriate law enforcement or regulatory authorities.
• Legal action to recover damages, costs, or to obtain injunctive relief.

We reserve the right to investigate any suspected violation of this policy and cooperate with law enforcement agencies in connection with any investigation of suspected illegal activity.

Your results will depend on your individual effort, experience, market conditions, niche, audience, and many other factors outside our control. Endromeda provides tools, frameworks, and strategy — not a guarantee of any specific financial result.

We make no warranty, express or implied, that you will achieve any particular revenue, follower growth, client acquisition, or business outcome by using our products. References to income figures in testimonials are exceptional results and should not be considered typical.

Nothing in our marketing materials constitutes a promise or guarantee of earnings. If you are not comfortable with this, please do not purchase.

Endromeda's app and services include AI-powered features such as script generation, hook writing, content strategy recommendations, caption drafting, and the MedaFlow system. These features are powered by third-party large language models, including Anthropic's Claude API. By using any AI feature within our platform, you acknowledge and agree to the following.

AI Outputs Are Suggestions, Not Guarantees

All content, text, strategies, recommendations, and other outputs generated by our AI tools ("AI Outputs") are provided for informational and creative-assistance purposes only. AI Outputs:

• Are not guaranteed to be accurate, complete, current, original, or fit for any particular purpose.
• Do not constitute legal, financial, medical, tax, psychological, or any other form of professional advice.
• May contain errors, outdated information, or content that is not appropriate for your specific audience, jurisdiction, or platform.
• May occasionally produce outputs that are inconsistent, repetitive, or unexpected in nature — this is inherent to how large language models work.

You are solely responsible for reviewing, editing, fact-checking, and ensuring the appropriateness of any AI Output before using it publicly or commercially. We strongly recommend human review of all AI-generated content prior to publication.

Intellectual Property of AI Outputs

• You retain ownership of AI Outputs generated using your inputs on our platform, subject to Anthropic's usage policies.
• We do not claim ownership of your specific AI Outputs. However, we retain rights to the prompts, systems, and workflows underlying our AI features.
• We make no representation that AI Outputs are free from third-party intellectual property claims. You use AI Outputs at your own risk from an IP perspective and are responsible for ensuring their use does not infringe any third-party rights.
• Do not use AI Outputs to make verbatim copies of material that may be copyright-protected without independently verifying your rights to do so.

How AI Features Work — Data & Privacy

• AI features operate through server-side Supabase Edge Functions. Your inputs are sent to Anthropic's API for processing. Your inputs are never processed client-side, and our Anthropic API key is never exposed to your browser.
• Anthropic may process inputs according to their own Privacy Policy and Usage Policy. By using our AI features, you also agree to comply with Anthropic's acceptable use policies.
• We do not intentionally store your raw AI conversation inputs beyond what is necessary for generating your output within the session, unless a feature explicitly saves content to your account (e.g., saving a script to your Content Bible).
• We do not use your AI inputs or outputs to train AI models, and we do not share them with third parties for any purpose other than generating the requested output.

AI Platform Compliance

You acknowledge that content distributed via third-party platforms (e.g., Instagram, TikTok, YouTube) may be subject to those platforms' own policies regarding AI-generated content, including disclosure requirements. You are solely responsible for compliance with any platform-specific rules or applicable law regarding AI content labelling or disclosure in your jurisdiction.

No Endorsement

AI Outputs do not represent the views, opinions, or endorsements of Endromeda. Brand names, statistics, or claims that may appear in AI Outputs are not independently verified by us and should not be relied upon without your own research and verification.

Our services are provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including but not limited to:

• Fitness for a particular purpose.
• Non-infringement of third-party rights.
• Uninterrupted or error-free service.
• Accuracy or completeness of any content or information provided.

We do not warrant that our website will be available at all times, free from viruses, or that defects will be corrected. We reserve the right to suspend or discontinue any part of our service at any time without notice.

Some jurisdictions do not allow the exclusion of implied warranties. In such jurisdictions, our liability is limited to the minimum extent permitted by applicable law.

To the maximum extent permitted by applicable law, Endromeda, its founders, employees, and contractors shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages.
• Loss of profits, revenue, data, goodwill, or business opportunities.
• Damages arising from your use of or inability to use our services.
• Third-party actions or content.

In all cases, our total cumulative liability to you — whether in contract, tort, or otherwise — shall not exceed the total amount you paid to Endromeda in the 12 months preceding the claim.

Some jurisdictions do not allow the limitation of liability for certain damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law.

You agree to indemnify, defend, and hold harmless Endromeda and its founders, team members, affiliates, and contractors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

• Your use of our services or website.
• Your violation of these Terms.
• Your violation of any third-party rights, including intellectual property or privacy rights.
• Any content you submit, provide, or transmit through our services.

For Done-For-You Brand clients, both parties agree to keep confidential any non-public business information shared during the engagement (including your business strategy, financials, or audience data shared with us, and our proprietary methodologies and processes shared with you).

Neither party shall disclose the other's confidential information to third parties without prior written consent, except as required by law. This obligation survives termination of the service agreement for a period of 2 years.

These Terms shall be governed by and construed in accordance with applicable law. We strongly prefer to resolve all disputes amicably through direct communication first.

Step 1 — Direct resolution: Before initiating any formal proceeding, you agree to contact us at hello@endromeda.xyz to attempt good-faith resolution. We will respond within 5 business days.

Step 2 — Mediation: If direct resolution fails within 30 days, either party may request non-binding mediation before proceeding to any formal legal action.

Step 3 — Legal proceedings: Any unresolved dispute may be brought before a court of competent jurisdiction. Nothing in this clause prevents either party from seeking urgent injunctive relief to prevent irreparable harm.

For EU/UK consumers: Nothing in these Terms affects your statutory rights as a consumer under applicable consumer protection law in your country of residence.

You may terminate a subscription at any time through the Stripe customer portal or by emailing hello@endromeda.xyz. Termination takes effect at the end of your current billing period.

We may suspend or terminate your access to our services immediately and without notice if you:

• Violate any provision of these Terms.
• Engage in fraudulent, abusive, or illegal activity.
• Fail to pay any amounts owed.
• Take actions that damage Endromeda's reputation or services.

Upon termination, your licence to use delivered materials is revoked for subscriptions (but not for one-time product purchases, which grant a perpetual personal licence).

Sections 6 (IP), 8 (No Guarantee), 9 (AI Disclaimer), 10 (Disclaimers), 11 (Limitation of Liability), 12 (Indemnification), 13 (Confidentiality), and 14 (Governing Law) survive termination.

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date above and, for active subscribers, notify you via email at least 14 days before changes take effect.

Your continued use of our services after the effective date of any changes constitutes acceptance of the new Terms. If you do not agree with the changes, you may cancel your subscription before they take effect.

Entire agreement. These Terms and our Privacy Policy constitute the entire agreement between you and Endromeda with respect to the subject matter herein, and supersede all prior agreements, representations, and understandings.

Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

Waiver. Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

Assignment. You may not assign these Terms or any rights hereunder without our prior written consent. We may assign our rights and obligations without restriction.

No agency. Nothing in these Terms creates a partnership, agency, franchise, joint venture, or employment relationship between you and Endromeda.

Force majeure. We are not liable for delays or failure to perform caused by events beyond our reasonable control, including but not limited to internet outages, natural disasters, or government actions.
